How is Venue Determined for a Connecticut Medical Malpractice Claim Filed in State Court?
Venue is a legal term that refers to where a lawsuit should be filed; if a lawsuit is filed in the wrong courthouse, it could be dismissed. We would use our experience and judgment and file your lawsuit in the courthouse that is the best venue for your medical malpractice claim.
Most medical malpractice lawsuits are filed in state court. The trial level court in the state court system is the Superior Court of Connecticut. (If the claim involves the federal government acting for example through a federally funded clinic or a Veteran’s Administration facility, the action would have to be filed in federal court under the Federal Torts Claim Act; more on this later.)
For a state court civil action involving personal injuries or wrongful death arising from a negligent or careless medical provider, venue is determined by where a person resides or where an injury occurred. In short, a claim can be filed in the judicial district where you reside; where the defendant resides; or, if neither party parties reside in Connecticut, where the malpractice was committed or where the injury occurred. See Connecticut General Statute § 51-345. (And in some cases, depending on where a party lives, we can choose between two different judicial districts; more on this later.)
