What is the Deadline for Giving Notice Under the Connecticut Dram Shop Law to the Seller of Alcohol of the Intention to Bring a Claim for Injuries or Death Caused by a Drunk or Intoxicated Driver?
If you want to make a claim for injuries or death arising from a Connecticut motor vehicle accident involving a drunk or intoxicated driver against a bar, club, restaurant, or other entity or person that sold or provided alcohol to the drunk driver, you must first give written notice to that provider of that alcohol.
Pursuant to Connecticut General Statute Section 30-102, the written notice must be given to the seller of the alcohol within 120 DAYS of the sale or purveying of the alcohol.
At a minimum, the notice MUST contain this information:
– TIME when the alcohol was sold or given to the intoxicated person;
– DATE when the alcohol was sold or given to the intoxicated person;
– NAME of the drunk person(s) that was sold or given the alcohol;
– NAME of the person injured or killed in the accident;
– ADDRESS of the person injured or killed in the accident;
– TIME of the accident that injured or killed the victim of the accident;
– DATE of the accident that injured or killed the victim of the accident;
– PLACE where the person was injured or killed as a result of the accident.
